This is in Prince George's County, Maryland. I filed the Ch 7 on the day before the scheduled sale. The automatic stay expired more than eight months ago and the case is listed as INACTIVE on the court's docket. I know they can't just foreclose without notice, but how much of the formal process do they have to redo?

I was in foreclosure about a year ago and the foreclosure was interrupted by my filing of a chapter 7 bankruptcy. The bankruptcy was discharged in August 2010. The case has been inactive since then. When they resume the foreclosure, at what point do they pick up?

Great blog Owen, just wanted to add to your comment so other readers are aware. Even though the lender agrees to do a short sale. The lender can still file a deficiency judgment against you for the balance.

Pam, Foreclosure is the worst option. I would suggest you explore your options further. Homeowners have alternate solutions to foreclosure, they may not be the best option but it's the least worst option. Don't hesitate to ask if you have additional questions.

If you win the bid at the tax auction you can just sit tight because you most likely have more authority than the mortgage itself, meaning you can foreclose on the mortgage and not the other way around.

Get a real estate attorney in your state and verfiy

The lender will usually require such a person to come to the table with some cash or sign a promissory note in a strategic short sale. Its up to the Realtor to negotiate on behalf of the borrower favorable teams

I guess this is more of a question than a comment, why would a lender approve a strategic short sale when the person is already making a payment? So let's say you have a 90k short fall, the lender will make you pay all of that or is it negotiated?

You are probably right about the situation in California. My goal with the article is to make people aware of Tax Foreclosures. It also varies by state and/or county and the readers need to make sure that they stay on top of the laws in their area
